1. Acceptance of Terms

By creating an account or using Twilsoft ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Service.

2. Description of Service

Twilsoft provides a softphone application that connects directly to your Twilio account. Twilsoft is a software interface only. All telephony services, phone numbers, and call routing are provided by Twilio Inc. through your own Twilio account.

3. No Association with Twilio

Twilsoft is an independent product and is not associated with, endorsed by, sponsored by, or approved by Twilio Inc. Twilio is a registered trademark of Twilio Inc. Your use of Twilio services is governed by your own agreement with Twilio and their terms of service.

4. Your Twilio Account

You are solely responsible for your Twilio account, credentials, and any charges incurred through Twilio. Twilsoft stores your Twilio API credentials in encrypted form to facilitate the Service. You are responsible for ensuring your Twilio API keys have appropriate permissions and restrictions.

5. No Refund Policy

All payments made to Twilsoft are final and non-refundable. This includes subscription fees, setup fees, and any other charges. By subscribing to the Service, you acknowledge and accept this no-refund policy.

6. Service Availability and Downtime

Twilsoft is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation of the Service. Twilsoft is not responsible for any downtime, whether caused by:

  • Twilio service outages or maintenance
  • Network or internet connectivity issues
  • Planned or unplanned maintenance of Twilsoft systems
  • Force majeure events
  • Any other circumstances beyond our reasonable control

7. Account Suspension or Termination

If your Twilio account is suspended, terminated, or otherwise restricted by Twilio Inc., Twilsoft is not responsible and no refund will be provided. You acknowledge that Twilio may suspend or terminate your account at their discretion per their own terms of service.

8. Limitation of Liability

To the maximum extent permitted by law, Twilsoft and its owners, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.

9. Use at Your Own Risk

You acknowledge that the use of Twilsoft is entirely at your own risk. You are responsible for compliance with all applicable laws and regulations regarding telecommunications, including but not limited to call recording laws, robocalling regulations, and TCPA compliance.

10. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will make reasonable efforts to notify users of significant changes.
